Terms and Conditions of the UICC Cancer Control Community

  1. AGREEMENT - The Global Cancer Control Community consists of the time sharing services, data and databases that are offered as a custom electronic communications network ("The Network") sponsored and operated by UICC. This Agreement contains the entire Agreement between you (the individual Community member) and the UICC and supersedes all prior written and oral understandings and writings. This Agreement may be revised by UICC at any time upon written notification by UICC, and you agree that you shall be bound by the terms of any such revised agreement, subject to your right to terminate your membership under Sections 2 and 7 below.
  2. RESPONSIBILITY FOR ACCOUNT USAGE - You are responsible for all information or action generated by you under your Common Interest Group identification and for any violation of this Agreement by you.
  3. RIGHTS OF INFORMATION - All information offered on the Network is the sole and exclusive property of either UICC, or its subcontractors and you agree that, unless specific permission is granted in writing, you will not publish, broadcast, retransmit, or resell such information or in any way violate the copyright of any provider of information to the Network. This provision is for the benefit of UICC and its subcontractors and each shall have the right to enforce its rights hereunder and on its own behalf.
  4. CONTENT - Any content that is contributed or placed on the Network becomes the property of UICC and may be used by UICC to determine future programming, conference/Congress content, publish and otherwise use the contributions of Network members
  5. MANAGEMENT OF THE NETWORK - UICC reserves the right to add, modify, or delete any of the services offered on the Network at any time.
  6. DISCLAIMER OF WARRANTIES - Network services are offered on an AS IS basis. Neither UICC nor its subcontractors make any warranties, express or implied, concerning these services, including without limitation, warranties of merchantability and warranties of fitness for a particular purpose.
  7. In no event shall UICC or its subcontractors be liable for any direct, indirect, special or consequential damages caused by any failure of performance, mistakes, omissions, interruptions, deletion of files, defects, delays in operations or transmission, communication line failures, theft, destruction, unauthorized access to or use of your Network records, files or programmes, or for any failure to perform by UICC or its subcontractors due to any cause beyond their control.

  1. TERM AND TERMINATION - This Agreement is effective from the date of acceptance by UICC of your registration application. Except as indicated below and in Section 2 hereof, this Agreement may be terminated by either party without cause upon 30 days written notice to the other party.
  2. UICC shall have the right to terminate this Agreement or suspend access to the Network without notice in the event that you:

    1. have breached this Agreement in any way;
    2. have used the Network for unlawful or improper purpose or unauthorized advertising;
    3. have interfered or threatened to interfere with any other person's privacy or proprietary rights;
    4. have proffered insults towards other Network Subscriber(s);
    5. are more than 30 days in default in the payment of any dues or charges.

    Neither the UICC nor its subcontractors shall be liable to you for any cost, expense, or damages whatsoever for terminating this Agreement as provided in Section 7 hereof.

  3. USER IDENTIFICATION- All Community members shall confirm that they are not an agent, employee, affiliate or have a relationship to any company that grows, processes, sells or promotes any tobacco product or the use of tobacco products or otherwise have a conflict of interest due to a current, past or potential relationship with a tobacco company.
  4. MISCELLANEOUS - This Agreement is subject to approval by UICC and may not be assigned by you. It is subject to the laws of Geneva, Switzerland.
